Affirmative Action Plans

Companies with 50 or more employees and who meet at least one of the following criteria must develop written affirmative action programs:

  • Holding a federal contract or subcontract of $50,000 or more;
  • Depository of government funds in any amount;
  • Serving as a financial institution that is an issuing or paying agent for US Savings Bonds and Savings Notes in any amount.

The Office of Federal Contract Compliance (OFCCP) monitors federal contractors’ compliance with the affirmative action requirements and may suspend or cancel contracts of any employers who don’t meet their obligations. The OFCCP has broad enforcement authority and may seek back pay and wage adjustments if it finds selection or compensation discrimination.
